Tareq M. Alosh

Overview

Tareq Alosh is a litigator and patent attorney in the Chicago office of Kirkland & Ellis LLP. His practice focuses on patent, trade secret and commercial disputes involving technically complex issues. Tareq provides strategic counsel and litigates cases in courts across the country for clients ranging from large medical device and pharmaceutical companies to tech start-ups. His experience includes trying cases through jury verdicts.

Before joining Kirkland, Tareq had a distinguished career in the federal government. Tareq was a patent examiner at the U.S. Patent and Trademark Office for several years, where he earned his appointment as a Primary Examiner and was designated a technical expert, search expert and quality nominee. Clients frequently call upon Tareq to develop sophisticated case strategies for inter partes review that complement parallel district court litigation, including claims of inequitable conduct and estoppel. In one year alone, Tareq managed over a dozen inter partes reviews alongside active district court litigations.

Tareq has also clerked for the Appellate Staff of the Civil Division at the U.S. Department of Justice and performed research at NASA Goddard Space Flight Center for which he was named a John Mather Nobel Scholar.

DexCom, Inc. v. Abbott Diabetes Care Inc., et al.: Represent Abbott in global litigation involving continuous glucose monitoring devices for diabetics.

Med-El GmbH, et al. v. Advanced Bionics, et al.: Represent Advanced Bionics and Sonova (“AB”) as trial and appellate counsel in global litigation of patents relating to cochlear implants. Following successful dismissal of all of MED-EL’s infringement claims on summary judgment, obtained a jury verdict that MED-EL willfully infringed two AB patents.

Microspherix, LLC v. Merck Sharp & Dohme Corp., et al.: Represented Microspherix as trial counsel in district court litigation concerning infringement of patents covering radiopaque drug-eluting implants. On the evening before an IPR-estoppel hearing that could have eliminated Merck’s main invalidity defenses, and just three days before the start of a jury trial, obtained a near nine-figure settlement for Microspherix.

Pharmaceutical Litigation: Patent counsel for major pharmaceutical company in litigation seeking mixed royalty stream based on a license agreement.

Johnson Controls Tech. Co. v. Willow Techs., LLC et al.: Represented Willow Technologies in district court litigation and inter partes review proceedings over patents involving digital twin software. Shortly after filing several petitions for inter partes review and counterclaims of inequitable conduct, the parties settled all litigation.

OE Manufacturer Trade Secrets: Counseled client on U.S. and international trade secret misappropriation concerning software used in autonomous driving applications.
